Offer Letter Acceptance

In signing the Enrolment Contract (Section Four), you agree that you fully understand the Whitecliffe Student Withdrawal and Refunds Policy, which is established in compliance with the Education Act 2020.

• If a student withdraws before commencement (before the first day of required attendance/learning either online or in-class), students will receive a full refund.
• If a domestic student withdraws within eight (8) days after commencement (including weekends), he/she is entitled to a refund of any course fees paid, reduced by the lesser of an administration charge of $500 or 10% of the course fees. If a student who withdraws has not paid any fees, he/she remains liable for the administration charge. If a student has not paid their course fees to Public Trust, then the administration charge is payable to Whitecliffe College directly.
• If a student withdraws more than eight (8) days (domestic) after commencement, he/she is not entitled to any refund. If a student who withdraws has not paid any fees, he/she remains liable for the total fees amount.

In signing the Enrolment Contract (Section Four), you agree that Whitecliffe Education Ltd, or its affiliated entities, may use your work, image (photograph) or voice for educational purposes and/or in its exhibitions, publications, advertising, or other media activities (including the Internet) without expectation of compensation or other remuneration, now or in the future.

You retain ownership of what you produce while at Whitecliffe, and once you have left Whitecliffe, only copies of your work can be used, unless you agree otherwise. (There are separate Consent and Release Forms for using your work once you have left and for the use of video recordings of you).

Information below provides greater detail noting:

• What Whitecliffe may use;
• How they may use it;
• Who the audience would be;
• What happens once you leave; and
• Whitecliffe’s responsibility.

It is important that you read the following statements and confirm your understanding and agreement when signing the enrolment contract.

Whitecliffe may use work produced by you, or your image for:

• Educational purposes in classroom or online teaching environments and as such may be posted on the Whitecliffe Learning Management System and available to all students.
• Exhibiting either on Whitecliffe premises or an offsite venue.
• An example of student work displayed on the premises.
• Advertising and promotion of Whitecliffe nationally and/or internationally.
• Required external monitoring.

The audience will be one or more of the categories listed below:

• Whitecliffe staff
• Staff and students in the same or similar programmes of study online or in class
• Other Whitecliffe students and/or staff
• General public who visits the location
• General public nationally
• General public internationally
• Potential students or agencies nationally
• Potential students or agents internationally

Whitecliffe agrees to:

• Accurately attribute your involvement in producing the work.
• Respect the integrity of the work by not using it in a way that is knowingly damaging to your mana or reputation.

Additionally, for students from the School of Creative Arts Therapies (SoCAT):

• Any work produced by SoCAT students implicating work with clients and/or confidential therapeutic processes may not be used by Whitecliffe under this agreement.
• Work produced by SoCAT students with the intention of sharing with the public may be used under this agreement; namely, published dissertations and artwork/artist statements and photographic images taken as part of the end-of-year graduate exhibition.
• As seminar teaching sessions often involve deeply personal creative therapeutic processes, informed consent must be obtained from relevant SoCAT Faculty and students before photographs are taken / used publicly.

Privacy

Whitecliffe complies with the Privacy Act 2020 which is designed to protect the privacy of individuals. It governs the collection, use, storage and disclosure of personal information in accordance with the twelve information privacy principles in the Act. View the Act

Whitecliffe Education Ltd (Whitecliffe) collects and stores information from this form to:

• Manage the business of Whitecliffe including internal reporting and administrative processes.
• Comply with the requirements of the Education and Training Act 2020 and other legislation relating to the maintenance of records.
• Supply information to government agencies and other organisations set out below.

In signing this enrolment form, you authorise the disclosure of your personal information for the stated purposes on the understanding that Whitecliffe (and any government agencies) will comply with the legal requirements in relation to the use and disclosure of personal information as set out in the Privacy Act 2020, the Education and Training Act 2020 and other relevant legislation. You are entitled to see any information that Whitecliffe holds about you and request to correct any errors in that information. To do so, please contact Admissions.

Whitecliffe supplies data collected on this form to government agencies including the Ministry of Education, Education New Zealand, the New Zealand Qualifications Authority, the Tertiary Education Commission, the Ministry of Social Development (in relation to student loans and allowances) and Inland Revenue (student loans), Immigration New Zealand (for those who are not New Zealand citizens or permanent residents), the Ministry of Business, Innovation and Employment, and agencies who support particular students through scholarships, payment of fees or other awards (if you are a recipient of one of these awards).

These agencies use the data collected to:

• Administer the tertiary education system, including funding and Fees-Free initiatives
• Develop policy advice for government
• Conduct statistical analysis and research

Your personal details (name, date of birth, residency) will be included in the National Student Index (NSI) and may be used in an authorised information matching programme with the NZ Birth Register.

When required by law, Whitecliffe releases information to government agencies such as the New Zealand Police, Department of Justice, Ministry of Social Development, and the Accident Compensation Corporation (ACC).

Information collected on this form may also be supplied to other educational organisations for the purpose of verifying academic records.

Fees

You undertake to pay all fees as they become due, and to meet any late fees and collection charges associated with debt recovery. Whitecliffe’s policy on withdrawal and refund of fees may be obtained from student services.

Rules

You undertake to comply with the published rules and policies of Whitecliffe regarding attendance, academic integrity and progress, code of conduct, health and safety, and behaviour.

You release Whitecliffe from all liability for personal accident, injury, illness or loss of personal equipment which may result from your involvement with Whitecliffe, including participation in field trips and related travel.

You accept full personal liability for any loss or damage to Whitecliffe materials or equipment (e.g., books, cameras, etc.) for which you are responsible, and understand that Whitecliffe provides no insurance for material or equipment used outside Whitecliffe premises except when such use is under the direct supervision of Whitecliffe tutorial or technical staff.

In signing below, I declare that I have read, understood and accept all items and conditions outlined in this document, and to the best of my knowledge, all of the information supplied on and with my Application to Enrol is true and complete. I agree to abide by the conditions described above, and consent to the disclosure of personal information as described above.
